INFORMATION LETTER FOR PROTECTING OF PERSONAL DATA

 

Acting as the “Data Controller” we, Turkish Foundation For Waste Reduction – Turkish Grameen Microfinance Program (“TGMP”) located in “Bademlidere Mahallesi, 265. Sokak, No: 4/9, Ulusoy Apartmanı, Kat: 2, 06700, Çankaya/Ankara”, having registered with 394045 trade registry number at the Ankara Trade Registry Office, having 8573762146672622 mersis number, would like to kindly inform you regarding to our obligations under the Personal Data Protection Law numbered 6698 (the “PDPL”) and the relevant legislation thereto as follows:

According the PDPL, personal data means any information relating to an identified or identifiable natural person (the “Personal Data”) and special categories of personal data means the information relating to the race, ethnic origin, political opinion, philosophical belief, religion, religious sect or other belief, appearance, membership to associations, foundations or trade-unions, data concerning health, sexual life, criminal convictions and security measures, and the biometric and genetic data (the “Special Categories of Personal Data”).

Acting as the Data Controller we would like to kindly remind you that your Personal Data which you have submitted and/or have been submitted to TGMP will be recorded, stored, preserved, rearranged, shared with the institutions that are legally authorized to request this data, under the purpose that requires their processing in a limited, relevant and proportionate manner, and in other ways that are prescribed under the scope of the PDPL.

  1. Collection and Legal Reasons for Processing Your Personal Data

Your Personal Data, which you submit verbally or in writing, electronically and/or by automatic or non-automatic means, at http://www.tgmp.net/tr/; identity data (such as your name, surname, date and place of birth, gender, marital status, nationality), contact data (such as your e-mail address, address, mobile phone number), Special Categories Personal Data (if you include it in your CV, association, foundation, trade union, political party membership information, information about your religious or philosophical belief, ethnic origin, nationality and race or any other information that can form an opinion about it, information about your health), education data (Educational status, certificate and diploma information, specialist knowledge, foreign language information, education and skills, attended seminars and courses, computer usage information), work experience data (such as experience, employment status and title, work experiences), visual and audio data (such as real person photos, voice recordings) and other data (driver’s license data, competencies, hobby, salary expectation, military service status), reference information (reference person’s name, surname, title, workplace, phone, e-mail) and any presentation files you add.

The legal reasons for the processing of your Personal Data are as follows:

  1. a) Having your explicit consent;
  2. b) Expressly prescribed in other relevant laws;
  3. c) In connection with the conclusion or performance of a contract;
  4. d) Data has already been made public;
  5. e) Data processing is necessary for the establishment, exercise or protection of a right, and
  6. f) Data processing is necessary for our legitimate interests, provided that it does not violate your fundamental rights and freedoms.

The legal reason for processing your Special Categories of Personal Data is your explicit consent.

  1. Purpose of Processing Your Personal Data

Your Personal Data is processed for the following purposes:

  • Assessment of your job application by TGMP management and/or human resources department regarding whether your application meets the required conditions and qualifications of employment by TGMP,
  • To keep records in order to fulfill legal obligations and requests of administrative authorities, and
  • To be able to measure the social impact that TGMP has created over the society.
  1. Transfer of Your Personal Data and Purposes of Transfer

TGMP, due to your explicit consent or in other cases legally permitted, share your Personal Data with the organizations that provide storage, archiving, information technology support (hosting, cloud computing, e-mail and other), with cooperating and/or serviced insurance and service providers in the country and abroad. Your Personal Data can be transferred to accommodation companies, consultancy firms that receive support in legal and similar fields, and other third parties, our business partners and authorized institutions and organizations (domestically or abroad) to whom the transfer is required for specified purposes.

  1. Rights of Personal Data Owner under Article 11 of the PDPL

As a Personal Data Owner, you can ask for your rights set forth herein below from TGMP, acting as the Data Controller, at any time in accordance with Article 11 of the PDPL. The rights that you have in this context are as follows:

  • Learn whether or not Personal Data is processed,
  • Request information on the procedure if Personal Data has been processed,
  • Learn the purpose of processing Personal Data and whether or not such data are used in accordance with their purpose,
  • Obtain information about the third persons to whom personal data were transferred domestically or abroad,
  • Request correction of the Personal Data in case of incomplete or incorrect processing and request the notification of the transaction made within this framework to the third parties to whom the Personal Data has been transferred,
  • Although your Personal Data has been processed in accordance with the PDPL and other relevant law provisions thereto, in case the legal reasons requiring its processing disappear, request this data to be deleted, destroyed or anonymized and to notify the third parties to whom the personal data has been transferred in accordance with the provisions of the Regulation on the Deletion, Destruction or Anonymization of Personal Data,
  • Object to the emergence of a result against the person himself by analyzing the processed data exclusively through automated systems, and
  • Claim indemnification for any damages sustained as a consequence of processing personal data in violation of the relevant legislation.

The above-mentioned requests will be submitted to TGMP as the Data Controller in writing or by other methods to be determined by the Personal Data Protection Board (the “Board“). In this context, you can send your request regarding your above mentioned rights to our e-mail address, which may change from time to time, via your registered e-mail (KEP) address, with secure electronic signature, mobile signature or previously notified to TGMP by you and registered in TGMP’s system. By using your e-mail address (by attaching the documents identifying your identity) or to our postal address below, which may change from time to time, you can hand over the documents identifying your identity and a petition with your signature, or send it via a notary public.

 

In the application containing the explanations regarding the right you have as the Personal Data Owner and that you will make and request to use the above-mentioned rights; the subject you request must be clear and understandable, be related to yourself or if you are acting on behalf of someone else, you must be specifically authorized in this regard and this authority must be documented, and the application must include your identity and address information as well.

Your application shall be concluded free of charge within 30 (thirty) days at the latest depending on the nature of your application from the delivery to us through the specified means.
